<p>[9<sup>th</sup> April 2013] The Association of Nanny Agencies (ANA) held its first ever Career Fair for nannies and other childcare professionals at the end of last month and despite snow and freezing temperatures, attendance figures far exceeded expectation and the show was a resounding success. </p>
<p>The main aim of the day was to bring together childcare professionals and the many different agencies and other organisations that can offer advice and support for them. The exhibitors included nanny agency owners and managers, recruitment consultants, First Aid training providers, payroll and insurance service providers and committee members of ANA to name just a few. </p>
<p>The speaker events were very well attended, with lively question and answer sessions from the floor. Speakers included Anand Shukla, Chief Execuitve at the Day Care Trust; Dave Warboys from the Department for Business, Innovation &amp; Skills (BIS); Kirsty Wild from Nanny Tax as well as Angela Spencer and Margaret Cowell from ANA.</p>
<p>One particularly spirited session was hosted by Sarah-Jane Butler from Parental Choice who answered many questions relating to nanny contracts and other legal concerns. Sarah-Jane provided invaluable advice for nannies who do not have support from reputable agencies on legal matters.</p>
<p>There were unbeatable networking opportunities for everyone in the industry. Nannies were able to sign up with recruiters and training companies while agencies had a chance to meet and talk to some really great nannies.</p>
<p>Commenting on the event, one of the visitors, Moira Walsh from Fulham Nannies says, “There was something of interest for everyone and a great opportunity to talk to people and learn just how much support there is out there for us. Well done to ANA for organising this and I am looking forward to going next year.”</p>
<p>Angela Spencer, ANA’s chairperson, adds: “This event was really an opportunity to get everyone together in one place and show just how motivated and committed we are to moving forward and becoming a more professional and accountable industry. I think we achieved this with the first event and are already planning an even bigger event for next year.”</p>

<p>Can a Nanny be self employed?</p>
<p>Many parents ask if a nanny can be self employed and pay her own tax and national insurance.  The answer is usually no if they work for you under contract for the same amount of hours or same days per week.  </p>

<p>&#8216;Whether an individual is an employee or self-employed in a particular situation is a question of fact depending on the terms under which he or she works. When you engage someone to do work for you, you have to decide whether or not to apply the <acronym>PAYE</acronym> rules. It is up to you to get it right or suffer the consequences.In certain areas, <acronym>HM</acronym> Revenue &amp; Customs has placed emphasis on reclassifying individuals claiming to be self employed. They issued a leaflet, <acronym>ES/FSI</acronym>, Employed or Self-employed? setting out the guidelines of employment status in the form of questions. These cover the following principal factors:</p>
<ul>
<li>The degree of control and supervision exercised over the individual&#8217;s work</li>
<li>Whether services are performed mainly or wholly for one business</li>
<li>Where the duties are performed</li>
<li>Terms of pay, holiday time, pension arrangements, and other benefits</li>
<li>Whether the work has to be performed personally, or whether a substitute may be supplied</li>
<li>Provision of items of equipment</li>
<li>The financial risk and responsibility for loss undertaken by the individual</li>
</ul>
<p>Please note: We strongly recommend that if you are in any doubt as to the status of an individual, ask <acronym>HM</acronym> Revenue &amp; Customs to clarify the situation. Obtaining their approval will avoid the risk of you having to make a settlement of liabilities to tax or <acronym>NI </acronym>that you failed to deduct from the employee&#8217;s remuneration.</p>

			<content:encoded><![CDATA[<p>As the Festive season is upon us once again, many parents will be looking to use a babysitter for their children when going out. Making sure your child is safe, well cared for and happy is one of the biggest concerns of any parent. It can be very stressful leaving your child in someone else’s care and this is an extremely important decision you will have to make. There are no legal requirements on a person applying to work as a child carer (please visit <a title="www.ofsted.gov.uk" href="http://www.ofsted.gov.uk/" target="_blank">www.ofsted.gov.uk</a>), so it is up to you, as parent and employer, to ensure that you are employing a person who will look after your children well. </p>
<p>It’s a little known fact, but there is no set age when it’s ok to leave children home alone. It very much depends on whether the child is mature enough to be left and could cope with an emergency situation. According to the NSPCC: ‘The law does not set a minimum age at which children can be left alone. However, it is an offence to leave a child alone when doing so puts him or her at risk.’ They go on to recommend that no one under the age of 16 should be left to care for an infant.</p>
<p>A babysitter is usually a person who will look after the children in your own home, on an informal basis, usually for a few hours in the evening, when the children are asleep for most of the time.</p>
<p>Whilst it might be tempting to just use your neighbour’s teenage daughter, we wouldn’t recommend it unless your children are a bit older and they just need ‘supervising’ and not baby-sitting as such.</p>
<p>The best way is to use a trustworthy, experienced and qualified childcarer with a proven track record. The most reliable source is a nanny agency; you would have to pay a membership or a booking fee each time, but the babysitters they provide are of the highest calibre. They agency would have interviewed them, checked their ID, references and qualifications and made sure they have a current Criminal Records Bureau check and a valid First Aid certificate. As a member of the <strong>A</strong>ssociation of <strong>N</strong>anny <strong>A</strong>gencies(www.anauk.org), Coralis Childcare Agency has to follow strict rules and guidelines when recruiting and placing childcarers and babysitters.</p>
<p>Should you decide to source a babysitter yourself, please make sure you perform some basic checks such as proof of ID, child care qualifications, a valid First Aid and even ask to see a recent CRB check, which most people working in child care should already be required to have in their day job. You are inviting a complete stranger into your home to care for your children so follow your instincts and if it doesn’t feel right, then don’t use them.</p>
<p>Once you decide on the right person, book them to come half an hour early the first time you use them; this should allow enough time for the children to feel relaxed with the babysitter, it will give you some time to show her around and make her aware of bedtime routines etc and also see how the children interact with the babysitter. Always make sure you leave a contact telephone number and tell her how far you’ll be, should you need to be called back home in an emergency. Also, provide details of another person which could be contacted such a next door neighbour, grandparents or family doctor. Let the babysitter know an approximate time for your return. If you are going to be home later than anticipated, try to let her know as soon as you can.</p>

<p><strong>Why are these reports been distributed?</strong> </p>
<p>HMRC are introducing a new way of reporting PAYE information from April 2013: Real Time Information (RTI). This will affect all employers, including parents who employ nannies. It does not affect how salaries are agreed. Parents will only need to be more pro active when communicating salary changes to their payroll bureau, i.e. notify their payroll bureau of salary changes before pay day. </p>
<p><strong>How can Nannytax guarantee that net salaries can continue from April 2013?</strong> </p>
<p>Nannytax has been piloting RTI for HMRC since May 2012 and has been working with HMRC to iron out any potential niggles that the introduction of RTI will bring. </p>
<p>Nannytax uses licensed and approved HMRC software that allows net to gross conversion with RTI reporting. </p>
<p>Nannytax has been involved in detailed meetings with HMRC on RTI.</p>
<p> <strong><em>On saying all the above Nannytax still encourages parents, nannies and nanny agencies to agree salaries in gross terms.</em></strong></p>

			<content:encoded><![CDATA[<p><strong> </strong>The Association of Nanny Agencies (ANA), of which we are a member,  has warned against the dangers of parents using the internet to find childcare, following an incident on Gumtree where a convicted paedophile advertised himself as a babysitter, so he could then film himself abusing young girls.</p>
<p>The current economic climate has made things tougher for families and because of this, some opt for ‘quick fix’ solutions and use the internet to find and recruit their childcare.  This means that the only fee they have to pay may be a nominal advertising fee, or something similar.  These sites provide no formal checks or guarantees as to the identity or credibility of the person.<br />
Says Angela Spencer, Director of ANA: “Any parent seeking childcare should ensure that every possible check has been performed regarding the babysitter&#8217;s/nanny’s overall suitability, to ensure that their children will be cared for in the most professional manner.  The nanny should have the appropriate skills and ability for the children’s age group, needs and ability”.</p>
<p>“It is very disturbing to think that parents could potentially be inviting a stranger in to their home to interview and consequentially meet their children, without having verified any of their details. In an era where we stress the importance of educating children about the dangers of the internet, parents also need to understand the same dangers apply to them.” </p>
<p>The Association of Nanny Agencies has a professional code of conduct in place to ensure all agencies meet with the legal obligations and duty of care for both the nanny and parent.  Although using an ANA approved agency, such as Coralis Childcare Agency, is a more expensive way of finding childcare, there is a methodical process in place to ensure candidates are credited for the professional carers that they are and that parents benefit from knowing their childcarers are vetted and checked by approved agencies”.</p>
